Information that concerns the purchase of real estates from foreighers (European citizens) in Poland from 1 May 2004
From 1st  May of  2004 are in effect in Poland the regulations of European Union on the purchase of Polish real estates  for European citizens, regulations which replace those that were in effect from 24 May 1920. This regulations import objectively, regularly and distinguishable criteria for the publication of authorisations on purchase of grounds and real estates  for European citizens. With the import and application of consequently European regulations it does not need is published authorisation from the minister Internal and Administration for the foreigh purchasers in Poland, which emanate from countries of European Union.
Are in effect however the following prohibitions: 1)purchase  rural and forestal extents, before the expiry 1ètj'as from the day of import of Poland in the EU
2)purchase of  second house, before the  end of the 5 years from the day of  enter of Poland in the EU .
Also with this regulations are suppressed also various barriers which existed previously for the acquisition of authorisations of purchase from European citizens. The minister Internal and Administration, the minister of Defence and the minister of Agriculture and Growth do not need to publish written authorisations, but they can they are opposed in case of some illegality.
Exceptions from the prohibition of market  before the 12 years
 The above  prohibitions of market rural and forestal extents before the 12 years do not concern however what European citizens  have acquired the authorisation of minister Internal and Administration. Moreover they do not concern the European citizens that wish they deal personally with the culture of particular rural extent, provided that they lived legally in Poland for 3 possessed years  and cultivated in advance the particular rural extent in concrete prefectures(the prefectures:Warunian-Masurian, Pomerian, Kuyavian-Pomerian, West Pomerian, Lublin, Lower Silesian, Opole, Great Poland). In the Great Poland they need 7 possessed years  permanent residence. The foreighers that fill these conditions are faced as the Polish citizens. Still they are excluded from the prohibition of market rural and forestal extents before the end of the 12 years  all foreighers buy such type extent in order to  invest in this. This investment markets do not need the authorisation of minister Internal and Administration but being in the same legislation that beings and the Polish citizen. This markets, that constitute exception from the rule, are checked by the Service of Rural Real estates, which can suppress the imminent market in case where it will realise that this is contrary to in the rural policy of Poland.
Acquisition of second residence before the expiry 5 years
 Right of acquisition of second residence before the expiry of 5 years from the import of Poland in the EU without it needs the authorisation of responsible minister they have: 1
) all foreign European citizens live legally for at least 4 possessed hro'nja in Poland
 2) that buy second residence amining at the growth tourist investments(touristic investments as hotel  units and other.
 Acquisition of rel estates  in the cities for foreign  European citizens. The foreign European citizens have the right to buy for their own use plotages  in the city in all the territory of Poland with maximum limit the 4.000sq.m.. This rule is not in effect for the investment companies.
